a militares espiar sin orden judicial<\/strong>"},"content":{"rendered":"\n<p><strong>La SCJN invalid\u00f3 que militares intercepten comunicaciones privadas de civiles, sin la previa autorizaci\u00f3n de un juez civil, en una determinaci\u00f3n por mayor\u00eda de ocho votos, en la que se anul\u00f3 la t\u00e9cnica de investigaci\u00f3n de intervenci\u00f3n de comunicaciones prevista en el C\u00f3digo Militar de Procedimientos Penales.<\/strong><\/p>\n\n\n\n<p><strong>El ministro Luis Mar\u00eda Aguilar dijo que, aunque en los art\u00edculos impugnados se refieren algunos controles para que se puedan a cabo dichas intervenciones, estos no son claros ni suficientes, dejando en claro que esta atribuci\u00f3n, lejos de generar certeza, genera incertidumbre ante los alcances que podr\u00eda tener dicha medida.<\/strong><\/p>\n\n\n\n<p><strong>As\u00ed, la Corte anul\u00f3 la facultad de los fiscales militares para solicitar a un juez, u ordenar directamente, la geolocalizaci\u00f3n en tiempo real de dispositivos m\u00f3viles, as\u00ed como la entrega de datos conservados por las empresas de telecomunicaciones sobre su uso.<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;Adem\u00e1s, invalid\u00f3 la atribuci\u00f3n de dichos fiscales para solicitar \u00f3rdenes de cateo a domicilios privados o instalaciones civiles de
