La Polic\u00eda Investigadora de Delitos de Corrupci\u00f3n detuvo a Juan Carlos N, secretario t\u00e9cnico del Ayuntamiento de Tlahualilo, por su probable responsabilidad en el delito de Ejercicio Indebido del Servicio P\u00fablico, previsto en el art\u00edculo 326 del C\u00f3digo Penal del Estado Libre y Soberano de Durango, cometido en agravio del municipio en menci\u00f3n.<\/p>\n\n\n\n
El agente del Ministerio P\u00fablico especializado solicit\u00f3 al Juez de Control y enjuiciamiento la orden de aprehensi\u00f3n en contra del servidor p\u00fablico, misma que fue otorgada y cumplimentada con la finalidad de formularle la imputaci\u00f3n de hechos.<\/p>\n\n\n\n
Seg\u00fan la denuncia, interpuesta por los miembros del Cabildo, Juan Carlos N fue nombrado como secretario t\u00e9cnico del R. Ayuntamiento de Tlahualilo, Durango, sin cumplir con las formalidades legales.
Debido a lo anterior y a que el servidor p\u00fablico se vali\u00f3 de su parentesco con la actual alcaldesa de Tlahualilo para ejercer funciones sin satisfacer los requisitos legales en perjuicio de la administraci\u00f3n p\u00fablica de este municipio, la investigaci\u00f3n contin\u00faa en proceso con el fin de determinar si existen conductas que pudieran considerarse delitos de corrupci\u00f3n.
El art\u00edculo 326 en sus fracciones II y IV se\u00f1ala que comete el delito de Ejercicio Indebido del Servicio P\u00fablico quien:
\u2022 Ejerza las funciones de un cargo o comisi\u00f3n sin satisfacer los requisitos legales
\u2022 Se atribuya funciones o comisiones distintas a las que legalmente tenga encomendadas en perjuicio de terceros o de la funci\u00f3n p\u00fablica.<\/p>\n","protected":false},"excerpt":{"rendered":"
